General Conditions of Sale – Hummbird

Article 1 – Scope of application

These General Conditions of Sale (GCS) apply to all orders placed on the site hummbird.fr (hereinafter "the Site"), owned by Tech S (hereinafter "the Seller").
The Customer acknowledges having read the General Terms and Conditions and accepts them without reservation.

Article 3 – Products

The products offered for sale are described precisely on the Site (photographs, descriptions, sizes). The photographs are not contractual.

Article 4 – Prices

Prices are indicated in euros (€) , all taxes included ( TTC ), including the VAT applicable on the day of the order.
Delivery costs are calculated before validation of the order.

The Seller reserves the right to modify its prices at any time , but the products will be invoiced on the basis of the prices in effect at the time of the order.

Article 5 – Orders

To order:

  1. Add products to cart.
  2. Check and validate the order summary.
  3. Accept the T&Cs.
  4. Make the secure payment.

An order confirmation will be sent by email. The Seller reserves the right to cancel any order in the event of:

  • Dispute with the Customer.
  • Fraud or suspected fraud.

Article 6 – Payment

Payment is due upon ordering. Hummbird accepts the following payment methods:

  • Bank card (Visa, Mastercard, American Express).
  • PayPal.
  • Other secure payment solutions indicated on the Site.

Payment is secured via Shopify Payments and meets security standards.

Article 7 – Delivery

The products are delivered to the address indicated by the Customer at the time of ordering.

Delivery times : 5 to 12 working days (production + shipping).
In case of delay, an email will be sent to the Customer. Hummbird cannot be held responsible for delays caused by carriers.

Shipping costs : Calculated based on the shipping address.

Article 8 – Right of withdrawal

In accordance with European legislation, the Customer has a period of 14 calendar days to exercise his right of withdrawal.

Exceptions :

  • Personalized items.
  • Sale products.
  • Products returned without labels or used.

Return procedure :

  1. Declare the return on the portal 👉 https://account.hummbird.fr .
  2. Return the product in its original condition.
  3. Refund within 5 to 10 working days after inspection of the items.

Return costs are the responsibility of the Customer, except in the event of a defect or shipping error.

Article 9 – Legal guarantees

The Customer benefits from the legal guarantees of conformity and hidden defects provided for by articles 1641 to 1649 of the Belgian Civil Code .
In case of defective product, the Customer must send an email to info@hummbird.fr with photos.

Article 10 – Liability

The Seller cannot be held responsible:

  • Site interruptions.
  • From incorrect use of the products.
  • Delays related to carriers.

Article 11 – Force majeure

Neither party shall be liable for any non-performance or delay caused by a force majeure event (strike, natural disaster, etc.).

Article 12 – Protection of personal data

Personal data is collected and processed in accordance with the GDPR .
Purposes : order management, customer service, and sending newsletters.
Customer Rights : right of access, rectification, deletion, and opposition.

Article 13 – Dispute resolution

In the event of a dispute, you can use the European online dispute resolution (ODR) platform:

In the absence of an amicable agreement, the courts of the registered office of Tech S will have sole jurisdiction.

Article 14 – Applicable law

These General Terms and Conditions are subject to Belgian law .
